You wouldn’t know it to look at me, but at one time I was a young college student. As a matter of fact, at one time I was an SU student. I was also an SU instructor. As an attorney. I have represented countless young people who have in one form or another managed to find themselves (usually due to a momentary lapse of reason) on the unfortunate side of a legal dilemma.
Many times college is the first time a young adult has lived away from home. Along with the newly found freedoms come new opportunities to make a mistake. Sometimes it’s the result of poor judgement, sometimes it’s a product of naivety, sometimes just being in the wrong place at the wrong time gets you included in a charge that you may be totally innocent of, sometimes it’s police over reach or even police misconduct.
If this is your situation…take a deep breath or two… it’s not the end of the world. Most problems that the student finds him/herself in aren’t going to “ruin your life” or result in irreparable damage. It is very important, however, to address the problem properly, and in a timely manner. Please – don’t procrastinate. The problem is not going to magically resolve itself, and the judicial system not only frowns upon those who try to ignore the system – but they also never forget. Parents… I know that a child away from home is a special sort of worry. As a father of three former and current college students, I know where you’re coming from. You want to be able to afford them some sort of protection and at the same time want them to take responsibility for their actions as they “learn to fly”. I understand the balance. As an attorney I also understand that there are serious pitfalls to avoid in order to maximize the probability that their mistake, or simple misfortune, doesn’t wind up creating a permanent scar on their record or impede their further academic career. Depending on the severity of the offense, there are often alternative legal remedies to pursue that will allow a young person to avoid or expunge a conviction after a period of time – keeping her/his record clean. Many times, improper methods employed by law enforcement or the government’s attorneys will allow an experienced lawyer the opportunity to give his client a second chance… and as we all can remember from our own youth, a “near miss” with trouble can often be all that’s required to learn our lesson.
