Are you aware that Maryland is a contributory negligent state? This means if you are even just 1% contributory negligent you cannot recover. My advice would be to be very careful as to what you say to the insurance liability carrier. I would even advise that you not make any statement to the liability insurance carrier until you have had an opportunity to speak with and may employ counsel. This is because you may inadvertently say something which adversely affects your personal injury claim. The opposing insurance agent is NOT your friend and is NOT on your side, or even neutral – It is his or her job to find any reason not to pay you! Don’t give that to them! It is best to meet with your attorney and then let the attorney give the liability carrier a carefully prepared statement that tells how the accident occurred.

Worker’s Compensation laws establish an administrative procedure for compensatingworkers injured on the job. Instead of suing, an injured worker files a claim with the administrative agency or board that administers the local workers’ compensation claims. These agencies have quasi-judicial powers. All of their rulings are subject to review by the courts. In general, the right to recover under workers’ compensation laws is determined without regard to the existence of negligence or of fault in the traditional sense. Rather, it is predicated wholly on the employment relationship and the fact that the injury was accidental, arose out of, or in the course of, employment. Intentionally inflicted self-injury, for example, would not be considered accidental and hence would not be considered under the worker’s compensations schemes would not considerate it to have arisen out of, or in the course of, employment and hence would not cover it.
